The Inter-Club Agreement (ICA) is a mechanism that apportions cargo claims between owners and charterers under NYPE and ASBATIME time charters, sidestepping a fault inquiry under the charter terms. The current text is the Inter-Club New York Produce Exchange Agreement 1996, amended September 2011. It allocates by claim type: claims from unseaworthiness or bad navigation fall 100 percent on owners; claims from loading, stowage, or discharge fall 100 percent on charterers; shortage and other claims split 50/50. Most P&I clubs in the International Group subscribe to it, so the split applies between their members as a matter of club practice.
