Common clear-grounds basis for expanded inspections.

Rule 5 in port State control practice refers to the clear-grounds provision that allows a PSC officer to move from an initial inspection to a more detailed examination. Where an inspection reveals clear grounds, for example missing or invalid certificates, evidence that the crew cannot perform essential operations, or visible serious deficiencies, the officer may carry out a more detailed inspection of the relevant areas. Clear grounds are the legal trigger for the expanded scope, and serious deficiencies found can lead to detention until rectified. The provision is set out in the regional MoU procedures and, for the EU, in Directive 2009/16/EC.
