Article 105 UNCLOS

E1. Maritime security, geopolitics and risk

Definition

Seizure of pirate ships and prosecution.

UNCLOS Article 105 grants every state universal jurisdiction over piracy. On the high seas, or anywhere outside the jurisdiction of any state, any state may seize a pirate ship or aircraft taken by piracy and under pirate control, arrest the persons, and seize the property aboard. The courts of the seizing state may decide the penalties and the action to be taken regarding the ship, aircraft, or property, subject to the rights of good-faith third parties. This is the legal basis for prosecuting captured pirates in the seizing state’s courts.
