Bill of lading clauses

C3. Logistics, freight forwarding and multimodal trade

Definition

Standard liner BL terms such as Himalaya, Paramount, Demise.

Bill of lading clauses are the standard liner terms printed on the reverse of an ocean bill of lading that allocate rights and liabilities. The Paramount clause incorporates the Hague or Hague-Visby Rules into the contract; the Himalaya clause extends the carrier’s defenses and limits to servants, agents, and stevedores; the Demise or Identity-of-Carrier clause fixes who the contracting carrier is. These clauses, not the front of the document, usually decide a cargo claim.
