Freight

A5. Maritime Law, private and commercial

Definition

Consideration for carriage; payable in advance, on delivery, or pro rata itineris.

Freight is the consideration paid for carriage. Its incidence depends on the contract: advance freight is earned on shipment and is not returnable if the goods are lost, freight on delivery is earned only on right delivery at destination, and pro rata freight (freight pro rata itineris) is payable where the voyage is lawfully abandoned short of destination by agreement. The common-law rule that freight and cargo claims may not be set off makes the timing of the earning clause commercially significant.
