Definition

Subject to transit passage under UNCLOS Part III.

Straits used for international navigation between one area of high seas or EEZ and another are subject to the transit-passage regime of UNCLOS Part III, which cannot be suspended and covers submerged transit and overflight. Some straits fall outside it: a strait formed by an island of the bordering state where a seaward route of similar convenience exists keeps innocent passage, and straits governed by long-standing conventions (the Turkish Straits under the Montreux Convention) keep their own regimes under Article 35(c).
