York-Antwerp Rules

A5. Maritime Law, private and commercial

Definition

CMI-drafted rules for adjustment of general average; current editions 1994, 2004, 2016.

The York-Antwerp Rules are the CMI-drafted code for adjusting general average, incorporated into charters and bills of lading by contract rather than by force of law. Several editions remain in live use because the incorporating clause fixes which applies: the 1994, 2004, and 2016 versions differ on salvage treatment, interest, commission, and time bars. YAR 2016, adopted at the CMI New York conference in May 2016, reinstated the 1994 salvage approach, dropped the 2004 limits on certain allowances, and added a one-year time bar on the average adjuster.
