Up to good safe port

Up to good safe port is charter-party language warranting that the ports and berths the charterer nominates will be safe ones the vessel can reach, use, and leave without danger that good navigation and seamanship cannot avoid. The safe-port warranty, set out in ‘The Eastern City’ (1958), requires that the vessel can get to, stay at, and return from the port without, in the absence of an abnormal occurrence, being exposed to danger. Nominating an unsafe port is a breach for which the owner can refuse the order or recover damage to the ship. The warranty covers physical, political, and weather hazards.
