BIMCO sanctions clauses are standard contractual provisions that allocate the risk of UN, EU, UK, and US sanctions exposure between parties to a charter party or other shipping contract. They give an owner or charterer the right to refuse a voyage, cargo, or counterparty that would breach an applicable sanctions regime, and address listing of vessels, persons, and entities. BIMCO publishes versions tailored to different trades, including a general Sanctions Clause for Time Charter Parties and a Designated Entities Clause. The clauses do not change the underlying law; they create a contractual exit and indemnity when performance would trigger sanctions liability under a named regime.
